Q: What happens if the day-to-day care of a child is equal between a paying parent and a receiving parent? A: In this situation, the paying parent does not have to pay any child maintenance for that child. In short, no x

I contacted child maintenance myself and they said even tho my daughters dad has her the same amount of time that I do as it’s split down the middle, he was still entitled to pay me £128.55 a month. Which he does. Because he threw the same thing at me about it being equal so he doesn’t have to pay. In short yes he does. Contact CM yourself and explain your situation. They told me the amount over the phone & also sent me a screenshot of the calculator to send to her dad x

He doesn’t have shared care 50/50 now only weekends Saturday & Sunday so he pays more x

Not usually no

The only way not to is to have a 50/50 lives with order or for both parents to agree on it, however, if one parent has opened a cms case then I doubt they would agree on it
