Feeling cheated with my SMP pay

Hi momma’s , I have been working 20hrs with this company for a year now . They had calculated my average weekly income as £132 . And they intended paying me £114 per week as maternity leave pay . This doesn’t look right to me as I earn £240 per week @ £12 per hours and work overtime with them . I intend to challenge this and take it up with the office , please advise is anyone in this situation and what do you think I should do ?

Yeah you should get the normal statutory amount then of £184 x

I totally agree this is a joke

It’s an average of your earnings (and overtime) between 17-25 weeks. You should be able to ask for the calculations

This is what I’m so scared of, I’m waiting for my SMP decision as I can’t get maternity from current employment because I’ve not been there long but I work 15-20 hours a week so I know they’re gonna offer me so little 😩

How it’s worked out is: on the 15th week before your due date is your qualifying week. That’s the week they use to work out your entitlement. If you worked less that week, that’s why your SMP is lower than you expected. It doesn’t matter how many hours you work or how much you earn on other weeks. It only matters on that particular week x

They asked me for 13 weeks worth of payslips from the past year to work out how much I should get, also said to use the weeks I earned the most to get the most.

@ Ashley I have worked consistently 20 hrs with them

Do you think I can take maternity allowance from the government instead of from my company . Because at least govt is £184 which is reasonably better than what my employer is offering?

Statutory is £184 a week for the first 6 weeks ot should be 90% of your wage then for the other 33 weeks ot should be Statutory xx

You can use this HMRC calculator and share with your employer. Gives you the breakdown of what your payments will be: https://www.gov.uk/maternity-paternity-calculator

@Alison thank you for these . I have done the calculations and it doesn’t look right , my company is paying me way less than what the calculations say !

Speak with your HR team, hopefully it’s resolved informally. But if needed, you can escalate through a grievance process with them.

Thank you everyone xxx
