Packaged out after leave

Hi, I was due to return to work next week but a call today that I am being packaged out. They have offered me 5 weeks pay and another 5 if I sign a form. Has anyone else had this happen? Should I fight them for more since they are supposed to give me a job?

I would contact a lawyer and see what they say, they might be able to get you a better package, I’m pretty sure this is what is going to happen to me when I return to work

How long have you worked there? I would ask for atleast 4 months salary or more if it’s a unique or specialized field. An employment lawyer can give you advice but expect to pay 250$ or so for a consultation.

I have worked there for 4 years

They're supposed to give you 2 weeks for every year you were there I believe. Also this happened to a co worker of mine. The only way the company could get away with it is by eliminating the role she was supposed to return to. I don't know if this place did something similar. Do not be pressured into signing. That's why they are adding the 5 for signing (which ends up only totalling 2 more weeks than what they legally need to give you based on the 4 years). Talk to a lawyer asap. It will be worth it in the end. Tell them you are seeking counsel and will not be signing anything until they have gone over everything.

2 weeks for every year is a minimum. I would ask for more. I was wrongly terminated without cause and I took double and half but the lawyer I talked to for a consult advised I ask for more.

Please do not sign anything until you speak with a lawyer. Which province are you in or is your industry federally regulated? What was the reason they provided? I'm not a lawyer but I work in HR and have a deep understanding of employment and employment related regulations so I can try to help if you don't have access to a lawyer.

I am in Ontario and in the trucking industry. My department no longer exists which is why I am being packaged out. They said if I hadn't been off this would have happened in December last year. My issue is that if I hadn't been off on leave already I would have been able to get EI but now I don't qualify and will be without any income after this payment.

If you've been there 4 years, you should get at least 8 weeks, however you could be entitled to more. I had the same thing happen to me, but they gave me 8 months notice that my position was no longer available within the company. I got spoke to an employment lawyer for free (30min free consult) and ended up getting more weeks after I negotiated with my employer. I suggest speaking to a free employment lawyer to get advice before signing anything

If they eliminated the role unfortunately they can legally package you out after your leave. I would still speak with a lawyer since they definitely can get you something better vs. What they're offering (that's why they're trying to make you sign right away). Are you unionized? Trucking is difficult for someone external to say in terms of which employment regulations (some are federally regulated based on where they truck and what commodities they deliver). If it was an entire departmental elimination, they may have been obligated to give a longer notice pay. Did they attempt to find you other work within the company/were you qualified for other work? For a parental leave, this is something that may have been required to do. Basically, ignore anyone here who is giving specific advice because there is not nearly enough information about your specific situation for anyone to give definitive advice. You definitely need a consultation with a lawyer just based on the info you have shared already.
