Maternity Leave payback

Hi all. I’m on maternity leave and was lucky enough to get an enhanced package which is 6 months full pay before going down to stat after that. My partner and have been discussing whether I can realistically return to work and I know that if I don’t, I’ll have to pay this money all back to my employer. Does anyone know if I’m able to deduct the statutory amount from those 6 months that have to be paid back or will I have to pay back full amount?

You don’t have to pay back statutory maternity pay, only the enhanced/occupational pay.

That’s what I don’t get… forgive me if I’m being silly. But do I pay my full salary back minus the statutory amount or do I pay full salary meaning I would’ve missed out on any statutory payments?

You shouldn’t have to miss out on the statutory payments How the employer asks you to repay it is a conversation between you and them though, it might be you’d need to discuss a payment plan but you have to clarify it with your HR or shared services

@Ema No I signed a contract saying that I would have to repay back in full if I decided not to return to work or tried to quit within the first year of my return to work. So now I’m thinking I should not touch my money just in case I decide I can’t go back to work, so I can repay. Just trying to figure out if I can deduct my stat from this amount for when I pay back or if they’ll be expecting the full whack from me.

You dont pay statutory back, so that will be deducted from your full pay for those months...meaning you only pay back your enhanced pay.
