Carrying over BH rights

Anyone knows the rights on being able to carry accrued holidays into next year whilst you've been on maternity leave? This is specifically regarding the accrued bank holidays as my employers policy does not allow to carry over holidays in general. But wonder if rights are different for being on maternity leave? Also I wasn't aware that I would need to take bank holidays before maternity leave to not loose them in the next year.

I'm in a similar situation, I've only been given my holidays from when I returned to work from maternity leave. Its frustrating because, I've questioned it & my manager hasn't looked into it yet. The company closes down between xmas & new year, so I'm approx 4 days short from the holidays that I've 'supposedly' got left for the year {they actually owe me 8 days}. I'm worried that they'll find some sort of loophole & refuse to give me the remainder of my holidays (or at least pay me for it) legally though companies have to either pay you for it or allow you to carry it over. We still accrue all of our holidays whilst on maternity leave, as we cannot take holidays.

I thought it was dependant on your companies policy. I'm able to carry a maximum of 5 days over to next year, and also be paid for a maximum of 5 days, so in theory could get 10 days that way. I've however decided to use mine to go back part time until the new year. Ironically, after booking my holiday they changed our company holiday period and it's now been extended from end of December to end of March. It might be worth checking the government website to see if you're entitled to carry them over due to mat leave though 😊 x

No one is above the law, so we are entitled to full holiday allowance including bank holidays.

Yes seems to be a bit of a gray area or at least even if you know you're right and your employers says otherwise, you can't really do much. To be honest I didn't even know we also get to accrue bank holidays during maternity until after I started it. But just don't know how to justify this to employer and argue that I am entitled. I got to carry over my full allowance plus missed bank holidays so I came back to 60+ days annual leave after my first. Less after my second as I worked 80% so got less holiday.

If your maternity leave falls across two holiday years, you are entitled to carry your leave over. You would not be able to take your annual leave if you’re on maternity leave.
