Mat leave/boding time question

Hi, in Cali. My employer has total 4 people working in office which includes 2 bosses. (So 2 employees?) I started last Aug and started my May leave end of June. I’m due to go back Oct. I for the life of me cannot get a straight answer online if I would qualify for bonding time. I’m having so much anxiety just thinking about going back to work. I spend every night time feeding applying for remote jobs. Someone please help.

I think if you qualify for EDD or the 6-8 weeks of disability from the delivery you then qualify for an additional 8 weeks of PFL (paid family leave) which is the paid bonding time but you have to apply online through the same website. From my understanding if you haven’t been at your job for 1 year you don’t qualify for FMLA. FMLA is unpaid job protection so when you take PFL that you’re job protected meaning they are required to hold your job for you. I was in the same boat and hadn’t been at my job a year and didn’t qualify for FMLA, so I talked with my HR and told them I wanted to take PFL that I was eligible for through the state and they still let me even though they’re not legally required to hold my job (FMLA). I believe to qualify your employer has to have more than 50 employees and you had to have worked more than 1 year

That’s FMLA, they dont contact your employer for PFL, I spoke with a representative for a while about it.

To qualify for paid disability leave (Edd) you have to have paid into it in the last 1.5 years Out of your paycheck I’m not sure about the company employee number. But I know that the company employee number matters for FMLA (just the job protection part) but You can call a representative at either Edd and PFL and they can walk you through it. It’s hard to get through but I just had to call a couple times in a row.

Qualifying for maternity leave (disability leave) and Paid family leave (PFL) through the state has nothing to do with your employer. You just have to be employed or looking for work and have paid into SDI. Pregnancy disability leave (PDL) is different and is dependent on how many employees your employer has and protects your job while you are out. Disability leave and PFL through the state are NOT job protection, but they do allow you to get at least partially paid while you are out on leave.
