Sole custody or live in parent

If he isn’t on the birth certificate he doesn’t have parental rights

I don’t mind him staying the night but not at this age. It’s not a permanent no just no for now. So I simply just communicate this or should I take action and go to court? His dad can be unpredictable so I just want to be prepared @Sophie
