@Daina actually he didn’t cause when the girl came in room he wasn’t there and she said it’s ok if any of you sign. But yeh his name on it
What state are you in? If the father of the child signed the birth certificate and she holds his last name, he has to agree and sign the paper work stating that he agrees to the child’s name change. If the child is insured, this will affect her insurance as well. Same with SSN. If the father does not agree, you can take him to family court but the judge will request why you would like the name change in addition to DNA testing. This will ultimately lead to child support. The judge will ask every question about the child’s well being and financial stability.
@DAYSH I am in Florida . I just found out he cheated on me for sure more than once . He haven’t seen her a month now we live 3 hours away. He is not very responsible that’s why honestly I wanna change her name . And I know he has kid from previous marriage . But didn’t know he also had another one in Hawaii 😒😒😒😒
Okay, you can file a petition for name change but it is $400. Call and confirm this matter. However, this case will ultimately begin and end in family court. The only way for the judge to fully agree is if the father gives up his rights as a parent. Florida is a 50/50 state so seek counsel from family court.

I would wait to change her name when the divorce is finalized. The judge will ask if you would like to change your name back to your maiden name. If you choose to say yes, you may request the name change for your daughter as well. Because of his indefinitely, absence as a parent, etc, judge may grant it. But it will still have to be paid for.
Save all of that documentation for court. It puts the child as risk because her safety is in question. To prevent him from having visitation rights.

Because Florida is a 50/50 state, the judge will grant the father of the child visitation. Especially if he is paying child support. Being supervised will be discussed during family court. During family court, I would print all of this documentation and bring it to family court. However, this is different for you because he has not seen her. For example — I am concerned about my daughter’s safety with her father because he has said “ “ to me. I am concerned that he may inflict these acts onto my daughter, etc. Don’t delete anything.

Him cheating on you has absolutely nothing to do with them letting you change the baby’s last name. Again, like someone else said unless he agrees or gives up his rights, it’s really not likely. Even in cases of domestic violence the name can’t be changed most of the time.
I understand that he sent those things to you, but even with those disturbing texts, he still has to agree for her name to be changed. 😞
