Work notice

I’m really confused by my work contract regarding serving them notice if I can’t come back to work full time after maternity leave. If I can’t come back, do I give them my 1 months notice during maternity leave or before I go on maternity? Thank you!!

As I understand it, it would be that you serve notice one month in advance of when you have told them you would be due back. So if you've told them you would have 9 months off, you would give notice at 8 months.

Ive just done this! I was in my final month of maternity leave and handed in my notice, with my final day being my last day of maternity leave so I would not have to return to work at all x

Thank you both so much for your help!

I don't know your job but if working full time is the issue, you can put in a request for less hours. Flexible working etc and if they refuse they have to give valid reasons why. 😀

@Rachel will definitely give this a try, worth a shot!

Another vote for flex working. You should submit a request outlining what you need etc, they are obliged to review it and provide you with an answer. You can also ask for a trial period if you aren’t sure of what would best suit you. If the answer if no then they need a valid reason for it too and it should all be done in writing. Here’s some info: https://www.citizensadvice.org.uk/work/flexible-working/if-your-employer-refuses-your-flexible-working-request/ If you choose not to return to work after mat leave, make sure you get paid for any holiday you have left - including the time you built up while you were on maternity leave.

Check as well that they won't ask you to return your maternity pay if you hand in notice immediately... this can happen!

@Tamsin Ive only got Statutory Maternity Pay coming my way so I don’t think they can ask for that back (I think) 🤔

@Rachel if it’s only stat they can’t☺️

@Jenny that’s reassuring thank you! I am going to have some additional maternity leave but it’s unpaid 🙄 thanks so much for your help it’s reassured me! X
